Hosting

Nature of the service and status as a technical provider

Magazengo publishes online software (SaaS) that allows its customers to create, operate and host their own online store. Magazengo is neither the seller, nor the manufacturer, nor the importer, nor the distributor of the products and services offered on the stores created using the service.

With regard to content published by its customers (text, images, product pages, code), Magazengo acts as a hosting provider within the meaning of article 6 I 2 of French law no. 2004-575 of 21 June 2004 and as a hosting service provider within the meaning of Regulation (EU) 2022/2065 of 19 October 2022 on digital services. Magazengo has no general obligation to monitor the content it stores and exercises no prior control over it.

Magazengo is neither a payment institution nor a payment service provider. Payments made on the stores are collected by Stripe, directly for the benefit of the merchant, under the terms set out in the terms and conditions.

Reporting illegal content

In accordance with article 16 of Regulation (EU) 2022/2065, anyone may report content they consider illegal on a store hosted by Magazengo by writing to signalement@magazengo.com.

To be handled effectively, a report must include:

  • — an explanation of the reasons why the content is considered illegal, referring where possible to the relevant legal provision;
  • — the exact electronic address (URL) where the content can be found;
  • — the name and email address of the person submitting the report;
  • — a statement confirming the good faith of the person submitting the report as to the accuracy of the information provided.

Magazengo acknowledges receipt of the report without delay, examines it diligently and in a non-arbitrary manner, then informs the reporting party of its decision and of the available means of redress. Presenting content as illegal in order to obtain its removal when that information is inaccurate may engage the civil and criminal liability of its author.

Intellectual property

The Magazengo trademark, logo, visual identity, architecture, source code, interfaces, themes supplied by the publisher and service documentation are protected by copyright, trademark law and, where applicable, database producers’ rights. Any reproduction, representation, adaptation or extraction, in whole or in part, without prior written authorisation is prohibited. Content published by merchants on their stores remains their exclusive property.

Complaints

Any complaint may be sent to reclamations@magazengo.com. Magazengo undertakes to acknowledge receipt and to respond within a reasonable time.

Governing law

The site and this legal notice are governed by French law. The terms under which disputes are settled are set out in the terms and conditions. Nothing herein deprives a consumer of the right to bring proceedings before the court of the place where they were domiciled at the time the contract was concluded or the damaging event occurred.
